Terms of Service

1. Agreement

By using CallFirst services you agree to these terms. CallFirst is operated by CallFirst LLC, a Florida limited liability company.

2. Our Service

CallFirst provides lead tiering services. We check your lead list against the criteria in your buyer profile using verified public and property data — including USPS address validation, property records, US Census Bureau information and NOAA storm reports — and deliver a report that places each lead in a tier: Hot, Warm, Cold, or Not scored.

3. Client Responsibilities

You agree that:

• Your lead list was obtained through lawful means
• You have the right to share the lead data with us
• You will use your report in compliance with all applicable laws including CAN-SPAM, TCPA, and applicable state marketing regulations
• You are responsible for how you contact the leads on your list

4. Payment Terms

• Payment is due before or upon delivery of your report
• All fees are non-refundable once the report has been delivered
• Pricing is provided during the demo process and confirmed before work begins

5. No Guarantee of Results

CallFirst places each lead in a tier by a published rule: the criteria you state, plus, for businesses whose demand is storm-driven, NOAA storm reports logged within 10 miles of the address. Each lead's written reason is generated by AI from the same facts. We do not guarantee:

• That leads in any tier will result in sales
• The accuracy of third-party data sources
• Specific conversion rates or business outcomes

Results will vary based on your product, sales process, and market conditions.

6. Intellectual Property

The CallFirst platform, the software that applies its tiering rule, and all associated technology are the property of CallFirst LLC. Your report is yours to use for your business purposes.

7. Data Handling

We handle all client data in accordance with our Privacy Policy. Lead lists are permanently deleted after report delivery.

8. Limitation of Liability

CallFirst LLC's liability is limited to the amount paid for the specific report in question. We are not liable for indirect, consequential, or incidental damages.

9. Changes to Terms

We may update these terms at any time. Continued use of our services constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by the laws of the State of Florida.
